1. About these terms

These Terms of Service apply when a person browses nollumi.com, creates an account, purchases a product or membership, submits a review, or otherwise uses a NOLLUMI service. By completing a purchase, the customer agrees to the terms presented before payment, including any policy specifically linked to the product or service purchased.

2. Eligibility and accounts

Customers must provide accurate, current and complete information. A person under the age required to enter a binding contract in their location may use the store only with the involvement and permission of a parent or legal guardian.

Customers are responsible for protecting account credentials and for activity carried out through their account, except to the extent caused by NOLLUMI’s failure to use reasonable care.

3. Products, colours and sets

We aim to describe and photograph products accurately. Screen settings, lighting and normal production variation can affect how colour, finish and texture appear. These differences do not remove any right where a product is materially different from its description or otherwise fails a consumer guarantee.

Where a listing is marked as a set, the listing description states what is included. Where a listing is marked random-colour, mystery or assorted, the colour or design is selected at random unless the product page expressly allows a choice.

4. Prices and payment

Prices are shown in the currency presented by the store and may be converted for international markets. The final product price, taxes, delivery charges and order total are displayed before payment where applicable.

We may correct a genuine pricing, description or technical error. If an error affects an order already placed, we will contact the customer and provide a lawful option, which may include confirming the corrected order or cancelling and refunding the affected amount.

5. Orders and availability

An order confirmation acknowledges receipt of an order; acceptance occurs when the order is processed for fulfilment. We may reject or cancel an order where reasonably necessary because of stock unavailability, payment failure, suspected fraud, an obvious error, a legal restriction, or an inability to deliver. If NOLLUMI cancels an order after payment, the affected amount will be refunded, subject to any separate lawful agreement with the customer.

6. Delivery, returns and membership

The Shipping Policy, Returns & Refunds Policy, and Membership & Subscription Policy form part of these terms where relevant to the purchase.

7. Reviews and customer content

A customer who submits a rating, review, photograph or other content confirms that it reflects their genuine experience, that they have the right to submit it, and that it does not contain unlawful, abusive, private, misleading or infringing material.

The customer gives NOLLUMI a non-exclusive, worldwide, royalty-free licence to host, reproduce and display submitted review content for operating and promoting NOLLUMI, subject to applicable privacy law. NOLLUMI may moderate or remove content where reasonably necessary for legality, privacy, relevance, platform integrity or safety. We will not edit a review in a way that changes its meaning or falsely suggests a different customer experience.

Verified-purchase labels indicate that our records associate the reviewer with a purchase of the reviewed product. They do not mean that NOLLUMI endorses the opinion.

8. Intellectual property

The NOLLUMI name, logos, site design, original text, graphics and other protected material may not be copied, republished or commercially used without permission, except where law permits.

9. Prohibited use

Customers must not misuse the store, attempt unauthorised access, interfere with security, submit false information, automate abusive requests, commit fraud, infringe another person’s rights, or use the service unlawfully.

10. Liability and consumer rights

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

To the maximum extent permitted by law, NOLLUMI is not liable for indirect or consequential loss that was not reasonably foreseeable, or for delay or failure caused by events outside our reasonable control. This limitation does not apply where it would be unlawful or where loss was caused by NOLLUMI’s fraud, wilful misconduct or failure to meet a non-excludable obligation.

11. Changes to these terms

We may update these terms for future use of the store. Changes do not retrospectively remove accrued rights. If a change materially affects an active recurring membership, we will provide reasonable notice and any cancellation right required by law before the change applies.

12. Governing law and contact

These terms are governed by the laws applicable in Australia and, where relevant, New South Wales, without excluding mandatory rights available in the customer’s place of residence.
